TERMS AND CONDITIONS
The agreement applies between you, the user, accessing the site www.colourofsport.co.uk and the owner of this website Colour of Sport Limited. Your agreement to accepting the terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these Terms and Conditions, you should cease to use the website.
1. Definitions and Interpretations
In this agreement the following terms shall have the following meanings:
Account means collectively the personal information and credentials used by registered users to access certain areas of the website and place orders;
Carrier means any third party responsible for delivering goods from our premises or suppliers to the customer;

Content means any text, graphics, images or data compilations and any other form of information capable of being stored in a computer that appears on, or forms part of, this website;
Goods means any products that Colour of Sport Limited advertises or makes available through this website;
Payment Information means any details required in order to purchase goods from this website;
Premises means Colour of Sport Limited’s place of business which is Prime House, 14 Porters Wood, St Albans, Hertfordshire, AL3 6PQ;
Purchase Information means collectively any orders, invoices, despatch notes, receipts or similar that may be in hard or electronic format;
User(s) means and third party access to this website;

2. International Customers
We are happy to accept orders from customers outside our place of residence, the United Kingdom. However, you as the purchaser of the goods will be deemed the importer of record and as such you will be responsible for ensuring importation complies with all relevant local laws applicable to the country the goods are being imported to and will be responsible for all charges associated with the importation of those goods. Colour of Sport accepts no responsibility for these charges and we will not make any calculations or estimates in respect of this matter. Please be aware that Goods may be inspected on arrival at port of entry for customs purposes and Colour of Sport cannot guarantee that the packaging of your goods will be free of tampering.
3. Intellectual Property
Subject to the exceptions in Clause 4 of these Terms and Conditions, all content included on this website including, but not limited to, data compilations, graphics, icons, images, logos, page layout, software, text and underlying code is the property of Colour of Sport, our affiliates or other relevant third parties. By continuing to use the website you accept that such material is protected by applicable United Kingdom and International intellectual property and other laws.
You may not reproduce, copy, distribute, store or in any other fashion re-use the material from the website unless otherwise indicated on the website itself, or with express written approval to do so by Colour of Sport.
4. Third Party Intellectual Property
Unless otherwise expressly indicated, all Intellectual Property rights, including but not limited to Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable.
5. Accounts
5.1 In order to purchase goods from this site you will need to register as a user which will contain certain personal data. Payment Information will only need to be entered at the point of purchase and payment details will not be stored on the website. By continuing to use the website you represent and warrant that;
5.1.1 all information you submit is accurate and truthful;
5.1.2 you have permission to submit payment information where permission is required;
5.1.3 you will keep the information accurate up to date
5.2 It is recommended that you do not share your Account details with any other person as Colour of Sport accepts no liability for any losses or damages incurred as a result of your Account details shared by you. If you use a shared computer it is recommended that you do not save your account details in the internet browser.
5.3 If you have any reason to believe that your account details have been compromised by another without your consent you should contact Colour of Sport immediately to suspend your account and confirm any recent and outstanding activity on your account.
6. Availability, Pricing and Goods Descriptions
6.1 Every effort has been made to ensure that the goods listed on this website are accurately described, correctly priced and available at the time an order is placed.
6.2 If upon receipt of your order we discover that the item is in fact not currently available to be shipped within our target delivery times, we will contact you to advise when the item might be available for delivery, discuss an alternative item that might be suitable or effect a refund if payment has already been received.
6.3 All prices are listed on the website and believed to be correct at the time of publication. Unless prices are affected by unexpected price fluctuations then the price quoted at the time of the order being placed will be the accepted price. Unexpected fluctuations may include the death of a sporting icon which causes a revision in the market price of items featuring that person. In such circumstances you will contacted with a revised price and asked if you wish to continue with your order.
6.4 All prices are quoted inclusive of VAT at the ruling rate applicable at the time of the order.
6.5 Where there is a separate charge for postage and packing the price will be clearly shown on the order form before the order is finalised and confirmed.
6.6 If upon receipt of your goods you believe there has been a mis-description of the goods on the website please contact us within 24 hrs of the receipt of the goods. At our discretion if we agree that the goods delivered are not as described on the website we will arrange for the goods to be returned and a refund or replacement to be issued.

9. Termination and Cancellation
9.1 Either Colour of Sport or you may terminate your Account. If Colour of Sport cancel your Account you will be notified by e-mail and we reserve the right to do so without giving reason.
9.2 Upon termination of the account any orders that have been paid for will be honoured, or at your discretion we will accept cancellation, as long as the items involved do not relate to personalised items, and a refund will be issued.
9.3 Upon termination any pending orders that have not yet been paid for will be cancelled.
10. Licence
10.1 You are permitted tot download and print extracts from this website for your own use on the following basis:
(a) no documents or related graphics on this website are modified in any way;
(b) no graphics on this website are used separately from the accompanying text; and
(c) any of our notices and this permission notice appear in all copies.
10.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on this website are owned by us or our suppliers. For the purposes of these terms and conditions, and use of extracts from this website other than in accordance with clause 10.1 above for any purpose is prohibited.

These Terms and Conditions and the relationship between you and Colour of Sport shall be governed by and construed in accordance with the Law of England and Wales and Colour of Sport and you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
If you access Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.
